Terms of Service
1. Identification
Café do Mar is a restaurant operated by Via Amarela, Lda, located on Praia de Santo António, Costa da Caparica, Portugal. Contact: viaamarela.caparica@gmail.com.
2. Acceptance of the Terms
By accessing the cafedomar.pt website, contacting us via WhatsApp, Facebook, Instagram or another digital channel, or using the establishment’s services, you declare that you accept these Terms of Service and our Privacy Policy.
3. Services Provided
- Restaurant and bar (meals, drinks, terrace).
- Table service, take-away and events.
- Handling of information requests and bookings via digital channels.
- Promotional communication and social media management.
4. Bookings
- Bookings may be made via WhatsApp, phone, social media or partner platforms.
- A booking is considered confirmed only after an express reply from the establishment.
- Group bookings of more than 10 people may require prepayment or a deposit.
- As a courtesy, we ask for at least 2 hours’ notice in case of cancellation.
5. Automated Service by AI
Service via WhatsApp, Facebook Messenger and Instagram Direct is partly or fully assisted by an artificial intelligence system. By starting a conversation on these channels, you accept this service model. You may request human service at any time.
Although we make every effort to ensure the accuracy of automated replies, we always recommend confirming critical information (prices, opening hours, availability) before travelling.
6. Payments
- We accept payments in cash, debit card, MB WAY and major credit cards.
- The prices shown include VAT at the applicable legal rate.
- The cover charge (couvert) is optional and itemised on the invoice.
7. Intellectual Property
All content on the cafedomar.pt website — including text, images, logos, photographs and graphic elements — is the property of Via Amarela, Lda or used under licence. Its total or partial reproduction without prior written authorisation is prohibited.
8. User Conduct
When interacting with us through digital channels, you undertake to:
- Not send illegal, offensive, discriminatory or misleading content.
- Not attempt to compromise the security of our systems.
- Not use the channels for unsolicited commercial purposes (spam).
- Respect the service team, whether human or automated.
We reserve the right to block users who breach these rules.
9. Limitation of Liability
Café do Mar is not liable for:
- Temporary unavailability of the website or service channels.
- Occasional errors in automated replies that have not caused verifiable direct harm.
- Content or actions of third-party platforms (Meta, Google, etc.).
- Indirect losses arising from the use of the digital services.
10. Alternative Dispute Resolution
Under Law no. 144/2015, consumers may turn to one of the alternative consumer dispute resolution bodies, namely:

11. Applicable Law and Jurisdiction
These Terms are governed by Portuguese law. Any dispute arising shall be subject to the jurisdiction of the District of Lisbon, with express waiver of any other.
12. Changes
We reserve the right to amend these Terms whenever necessary. Changes take effect on the date they are published on this page.
